In addition to a 1-year residency requirement, until recently, New York law required that the party filing for divorce have particular grounds to do so. However, on October 12, 2010, new legislation went into effect granting New Yorkers a "no-fault" divorce option, allowing spouses to end their marriages in cases where the relationship has broken down irretrievably for at least six months.

In a divorce, the spouses must come to an agreement concerning an array of matters, including the division of marital property, the custody of children, and spousal support, among other matters. In the event the spouses cannot come to an agreement, the court will make orders resolving those issues according to statutory guidelines. With respect to division of property in particular, New York law sets forth a system of "equitable distribution" whereby all property obtained during the marriage is divided equitably between the spouses, which does not necessarily mean equally.
