Criminal Defense

DUI and DWI

In Virginia, charges of driving while intoxicated (DWI) and driving under the influence of alcohol or drugs (DUI) are the same. The consequences for a first offense DUI can be devastating. Those penalties may include the following:

Administrative license suspension for 7 days.

Minimum $250 fine.

License revocation for 1 year.

Any court-ordered restitution.

Participation in the Alcohol Safety Action Program (ASAP).

Installation of an ignition interlock device.

A criminal record.


The mandatory minimum punishments increase if certain enhancements apply, such as, a BAC of 0.15% or higher or a prior DUI conviction. These enhancements could include mandatory imprisonment.
